Welcome to Kazzam, a service owned and operated by KAZZAM, LLC (”Kazzam”, “we” or “us”).

We’ve created this Privacy Policy (“Privacy Policy”) to describe how we handle the information we collect and receive through the Kazzam Platform, application, website and technology platform (the “Kazzam Platform” or the “Site”) or that we receive through any other means (including, without limitation, information collected offline, in person, over the telephone and/or by mail, or from third parties) about people who offer services (“Kazzamers”) and people who use those services (“Customers”, together with Kazzamers, “Users”). By using the Kazzam Platform, you thereby consent and agree to this Privacy Policy and the Terms of Service (the “Agreement”, which is available on our Site and accessible here (https://app.kazzam.com/terms-of-service). This Privacy Policy is incorporated into and subject to the Agreement. Please review the Agreement along with this Privacy Policy. Capitalized terms used in this Privacy Policy and not defined here shall have the definitions set forth in the Agreement. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY OR THE AGREEMENT, PLEASE DO NOT ACCESS OR USE THE KAZZAM PLATFORM.

You should keep a few things in mind as you read this Privacy Policy:

  • The Privacy Policy applies to your use of the Kazzam Platform. We call that use our "Services."
  • The Privacy Policy applies to any and all computers or devices you use to access our Services.
  • To the extent we provide you notice on the Kazzam Platform of different or additional privacy policies or practices (e.g., at the point of our collection), those additional terms shall govern such data collection and use.
  • The Kazzam Platform may contain links to third-party websites ("Third-Party Websites"). We are not responsible for the privacy practices used on Third-Party Websites. We encourage you to be aware when you leave our Site and to read the privacy policies of each website you go to.
  • Information We Collect and Receive

    We collect and receive information about Users in a variety of ways.
    Information that You Provide to Us
    We collect information from you during your use of the Kazzam Platform including, but not limited to:

  • When you set up an account;
  • When you list your services on the Kazzam Platform;
  • When you search for a Kazzamer;
  • When you fill out any forms through the Kazzam Platform;
  • When you book a Kazzamer or make a purchase;
  • When you use the Kazzam messaging system;
  • When you enter a sweepstakes or contest, or register for a promotional offer;
  • When you post User content;
  • When you use our mobile applications; or
  • When you otherwise communicate with us or other Users through the Kazzam Platform.
  • This list is not exhaustive, but rather illustrative. Our Privacy Policy applies to all uses of the Kazzam Platform.

    The information you provide directly to us may concern you or others and may include, but is not limited to: (a) name; (b) zip code; (c) email address; (d) telephone numbers (mobile, home and or business); (e) mailing address (home and/or business); (f) demographic information (e.g., gender); (g) date of birth; (h) photographs; (i) information about your party, request, need or services; (j) video or audio files; (k) in certain circumstances, payment and/or identity verification information; (m) social media information, such as account names and other details; and/or (m) any other content you include in private communications with other users through the Kazzam Platform or communications with us. It may also include information specific to the services that you are requesting or offering through the Kazzam Platform, such as a type of party you are throwing or the party services you offer. You are not required to provide us with such information, but certain features of the Kazzam Platform may not be accessible or available, absent the provision of the requested information.

    Information We Collect without Your Assistance

    We collect and store some of this information using cookies, web beacons and other technologies.

      • A cookie is a small data string that is written on your computer’s hard drive by a web server, a computer that hosts a website and responds to requests received from your computer. Cookies help provide a good user experience on a website. Among other things, cookies enable a website to maintain information when a user's web browser requests a series of web pages.

      • Our Site contains web beacons in the form of clear .gif files or a java script, which are electronic images that allow for the collection of information about your interactions on our site. Web beacons may be used to place advertisements, to understand website traffic patterns and the number of visitors to our Site, and to measure the effectiveness of advertisements or email advertising messages.

    • Social networks and other third-party plug-ins and widgets.
      • Our Site includes social network and other third-party plug-ins and widgets that may provide information to their associated social networks or third-parties about the website pages you visit, even if you do not click on or otherwise interact with the plug-in or widget and regardless of whether you have an account or other relationship with these social networks and third parties. Information is transmitted from your browser and may include an identifier assigned by the social network or third-party, information about your browser type, operating system, device type, IP address and the URL of the web page where the plug-in or widget appears.     • Depending on how you access and use our Services, we may receive:

    • Data log information. This is information we automatically collect and may store when you use our Services. It may include, for example:
      • Information about your interactions with our Site, other websites, apps, and other services you use, the content you view and information in cookies and similar technologies; and
      • Information about how you access our Site, other websites, apps, and other services, your browser or operating system, your Internet Protocol ("IP") address, and the website you visited before visiting our Site.

    • Device information. This is information we automatically collect and store about the device you use when you access our Services. (Note that by "device," we mean anything you use to access our Services. Device information includes, for example:

    • Information you provide about a third party. You may send someone else a communication from the Kazzam Platform, such as sending an invitation or message to a friend. If so, the information you provide (names, email addresses, mobile number, etc.) is used to facilitate the communication and is not used by us for any other marketing purpose unless we obtain consent from that person (and we may use the information to obtain consent) or we explicitly say otherwise. In addition, we may use such information to identify other means e.g. social media ad targeting to communicate with the person. Please be aware that when you use any such invitation or message functionality on the Kazzam Platform, your email address, mobile number, name or user name and message may be included in the communication sent to your addressee(s).

    How We Use the Information that We Collect

    To Provide Our Services

    We may use your information to provide our Services, to improve our Services or to advertise services to you. These uses may, but are not limited to, include the following:

    • To enable you to establish an account and use the Kazzam Platform, to verify your identity and whether you have authority to use our Services;
    • To operate and make available the Kazzam Platform;
    • To connect Kazzamers and Customers;
    • To enable payments among Customers, Kazzamers and us;
    • For Customer and Kazzamer support;
    • For internal record-keeping purposes;
    • To process billing and payment including sharing with third-party payment gateways and payment service providers in connection with the Kazzam Platform;
    • To analyze Site usage and improve our products and the Kazzam Platform,
    • To improve and maintain the Kazzam Platform and for product development;
    • To help prevent fraud or investigate suspected fraud or wrongdoing or other User complaints;
    • To target Ads;
    • To periodically send promotional emails regarding new or special offerings from Kazzam or other information that may interest you;
    • To administer surveys, sweepstakes, promotions, or contests;
    • With your consent, to contact you by text message regarding certain services or information you have requested;
    • With your consent, to contact you by telephone or text message regarding Kazzam Platform features, improvements, or other products and services that may interest you;
    • For market research purposes, including, but not limited to, the customization of the Kazzam Platform according to your interests, as well as for troubleshooting problems, and detecting and protecting against error, fraud or other criminal activity;
    • To contact you about goods and services that may interest you or with information about your use of the Kazzam Platform;
    • For other research and analytical purposes; and
    • To resolve disputes, to protect ourselves and other Users of the Kazzam Platform, and to enforce the Agreement, the Privacy Policy and any other legal terms that govern your use of the Kazzam Platform.
    • To directly or through tools of third-party service providers review, scan, or analyze your communications with other users exchanged via the Kazzam Platform for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research and customer support purposes. By using the Kazzam Platform, you consent that Kazzam, in its sole discretion, may, either directly or through third parties we engage to provide services to us, review, scan, analyze, and store your communications, whether done manually or through automated means.

    A Note on Our Use of Financial Information: We use financial information solely as authorized by you in accordance with the Kazzam Platform. To keep your financial data secure, we do not store full credit card information on our servers. We have contracted with a third party to execute and manage the processing of your payment card information. For more about security see the section below titled “Our Commitment to Security”.

    Combining Information and Our Use of Aggregated Information.

    We may combine information that we collect from you through the Kazzam Platform with information that we obtain from affiliated and nonaffiliated third parties, and information derived from any other products or services we provide. We may aggregate and/or de-identify information collected through the Kazzam Platform. We may use de-identified or aggregated data for any purpose, including without limitation for research and marketing purposes and may also share such data with any third parties, including without limitation, advertisers, promotional partners, and/or others. If aggregated information results in personally identifiable information, we will treat it as such.

    How We Share the Information We Collect and Receive

    We may use the information that you supply, including any personally identifiable information, to customize your experience with our Site. The personally identifiable information that you submit to our Site remains your property, but by submitting it to us, you grant us the right, subject to applicable state and federal law, to use that information for marketing purposes and as provided in this Privacy Policy.

    For example, we may share your email address with third parties who may communicate special, promotional or other offers. We may contact you directly via email to inform you of features and services available on our Site or provide you with other services or opportunities. We reserve the right to share with or sell, rent or lease the information we have, including any personally identifiable information, to any third party for any and all uses permitted by this Privacy Policy and applicable law. These third parties may include, but are not be limited to: (a) providers of direct marketing services and applications, including lookup and reference, data enhancement, suppression and validation; (b) telemarketers (where permitted by applicable law); and (c) direct marketers.     Who We Share Information With

    We may share your information with any affiliates of Kazzam, including but not limited to, Party City Holdco and its affiliates.

    Business partners
    We may share information with select business partners, who may use the information for a variety of purposes, including to provide you with portions of the services provided by the Kazzam Platform.

    Other parties in response to legal process or when necessary to protect our Services.
    We may disclose your information, including personally identifiable information when we have a good faith belief that:

    • It is necessary to respond to lawful governmental requests or legal process (for example, a court order, search warrant, or subpoena); or
    • It is necessary to protect our rights or property.

    Other parties in connection with certain business transactions.
    In the event that the ownership of Kazzam changes as a result of a merger, acquisition, sale of assets, or in the unlikely event of a bankruptcy, your information may be transferred to another company. If we believe a transfer results in a material change in the use of the information we've collected or received about you, you will be given the opportunity to opt out of the transfer.

    Protection of Kazzam and Others.
    We may disclose your information when we believe it appropriate to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the Terms of Service or any other legal terms governing use of the Kazzam Platform, and/or to protect our rights and property and the rights and property of other users.

    We may provide information about users to third parties for research purposes, in anonymized or aggregated form.

    Third Parties that Provide Content, Advertising Services, or Functionality on Our Services.
    Some of the functionality on our Site may be provided by third parties who are not affiliated with us. Such third parties include:

    • Audience-measurement companies, which help us measure the overall usage of our Services and compare that usage to other online services; and
    • Social networking services (like Facebook, Twitter, LinkedIn, and Google) that enable you to login to our Services and to share things you find on our Services with your social network

    These and other third parties may collect or receive information about your use of our Services, including through the use of cookies, web beacons and other technologies, and this information may be collected over time and combined with information collected on different websites and online services.

    If you choose to connect with a social networking service, such as Facebook, we may share information with that service, and that service may share information about you with us. We may use the information for the reasons explained in this Privacy Policy, but the main reason we use it is to make your experience on our Services more personal and social. For example, we might show you what content is popular among your connections on the social networking service or give you a glimpse of what your friends are saying about that content. It's important to remember that we don't control the privacy practices of these (or any other) Third-Party Websites. We encourage you to read those privacy policies before connecting to them.

    "Do Not Track" Signals

    Some web browsers may transmit "do not track" signals to the websites and other online services with which the browser communicates. There is no standard that governs what, if anything, websites should do when they receive these signals. We currently do not take action in response to these signals.

    Our Commitment to Security

    Although no one can guarantee the security of the information collected and received, we do employ appropriate physical, procedural and technological security measures, which are reasonably designed to help protect your personal information from unauthorized access or disclosure. Kazzam may use encryption, passwords, and physical security measures to help protect your personal information against unauthorized access and disclosure. No security measures are 100% reliable. Therefore, we do not promise and cannot guarantee, and thus you should not expect, that your personal information or private communications will not be collected, disclosed and/or used by others. You should take steps to protect against unauthorized access to your password, device and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, keeping your log-in and password private, and not recycling passwords from other websites or accounts. Kazzam is not responsible for the unauthorized use of your information nor for any lost, stolen, or compromised passwords, or for any activity on your account via unauthorized password activity.

    Children's Privacy

    Our Services are intended for a general audience. We do not knowingly collect, use, or disclose personal information from children under the age of 13 without prior parental consent, except as permitted by the Children's Online Privacy Protection Act. If you are a parent or guardian and believe that your child under the age of 13 has provided us with personal information without parental consent required by COPPA, we ask that you email us at legal@kazzam.com, or contact us via postal mail at: KAZZAM, LLC, 1 Bridge Plaza North, Suite 475, Fort Lee, NJ 07024. If we obtain actual knowledge that we have collected personal information from a child under the age of 13, that information will be immediately deleted from our database.

    If you have questions concerning our information use practices with respect to children, or if you would like to review, have deleted, or stop the further collection of your child's personal information, you may contact us using the above information.

    International Users

    We are based in the United States, and, regardless of where you use our Services or otherwise provide information to us, the information may be transferred to and maintained on servers located in the U.S. Please note that any information we obtain about you will be stored in accordance with U.S. privacy laws, regulations, and standards, which may not be equivalent to the laws in your country of residence. By using our Services or by providing us with your information, you consent to this collection, transfer, storage, and processing of information to and in the United States.

    California Privacy Rights

    Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice identifying the categories of personal customer information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. If you are a California resident and would like a copy of this notice, please submit a written request at the address immediately above.

    Changes to This Privacy Policy and Additional Information


    We invite you to post Content on or through our Kazzam Platform, including, but not limited to, your comments, pictures, and any other information. However, please be careful and responsible whenever you are online. If you choose to post User Content on or through the Kazzam Platform, such as through messaging or postings, that information: (a) may be or may become publicly available; (b) may be collected and used by third parties without our knowledge; and (c) may be used in a manner that may violate this Policy, the law, or your personal privacy.
